2010 Annexation issue concerning the Sunset Beach Specific Plan Guideline 2.2.10

 

The sentence “existing legal building sites shall not be subdivided in a manner that would create more parcels than the original number.” Needs to be reinstated back into the Tourist section of the current Sunset Beach Specific Plan (SBSP). The Planning Staff removed the mechanism from the SBSP to deny an application to subdivide parcels in the SB Tourist District.

Below is the evidence

On Aug 2, 2010 the Sunset Beach Negative Declaration was completed. On Aug 12, 2010 the Negative Declaration’s 30 day public review period started. Twelve days later at the August 24, 2010 Planning Session, the Planning staff introduced Guideline 2.2.10. PC, page 4, CEQA ANALYSIS/Review

  1. Guideline 2.2.10 removed the sentence from the 1990 Sunset Beach Specific plan that states, “existing legal building sites shall not be subdivided in a manner that would create more parcels than the original number.”
  2. And more importantly they presented the Aug 2010 rewritten Sunset Beach Specific Plan draft, which incorporated the zoning changes outline in Guideline 2.2.10. PC, page 6, Guideline 2.2.10 last two sentences
  3. Guideline 2.2.10 will rezone 1/3 of the land use in Sunset Beach by allowing the Tourist District to be subdivided in a manner that would create more parcels than the original number..

Sept. 28, 2010 Planning Commission meeting.

  1. The Planning Staff did not document or present Guideline 2.2.10 for the Planning Commission’s review or approval. Please see the Staff Notes
  2. But the staff submitted the Draft Sunset Beach Specific Plan which incorporated the zoning changes outline in Guideline 2.2.10.

Octorber 18, 2010 City Council meeting page 9,

  1. The Planning Staff did not document or present Guideline 2.2.10 for the City Council to review or approval.
  2. The sentence “existing legal building sites shall not be subdivided in a manner that would create more parcels than the original number.” Needs to be reinstated back into the Tourist section of the current Sunset Beach Specific Plan (SBSP). The Planning Staff removed the mechanism from the SBSP to deny an application to subdivide parcels in the SB Tourist District.But the staff submitted the Draft Sunset Beach Specific Plan which incorporated the zoning changes outline in Guideline 2.2.10.
  3. Very Important- There is a list of the approved Guidelines in the REQUEST FOR CITY COUNCIL ACTION document. Guideline sequence is 2.2.1.ii, 2.2.2 and then 2.3.8. Notice Guideline 2.2.10 is missing. It was never presented to the City Council for review and approval.
